Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of Jetmap's website, services, and applications (collectively, the “Service”). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
We reserve the right to update and change these Terms at any time. For material changes, we will provide reasonable prior notice (such as an email notification or a prominent notice on the Service) and will indicate the effective date of the updated Terms at the top of this page. Continued use of the Service after the effective date of any changes constitutes your consent to the revised Terms. You can review the most current version of the Terms at any time on this page.
Description of Service
Jetmap is a personal aviation logbook service that allows users to track their flight history, monitor frequent flyer status, analyze travel statistics, and share their aviation journey with others. The Service includes features such as:
- Flight logging and history tracking
- Interactive flight maps with route visualization
- Travel statistics and analytics
- Frequent flyer program monitoring and status tracking
- Public profile sharing capabilities
- Data import and export functionality
- Community features and user discovery
- Premium subscription features for enhanced functionality
Eligibility
You must be at least 13 years of age to use the Service. By agreeing to these Terms, you represent and warrant that you are at least 13 years of age. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.
Account Registration and Security
Creating an Account
To access certain features of the Service, you must register for an account. When you register, you agree to:
- Provide accurate, current, and complete information during the registration process
- Maintain and promptly update your account information to keep it accurate, current, and complete
- Maintain the security of your account by protecting your password and restricting access to your account
- Accept all responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account or any other breach of security
You are responsible for safeguarding the password that you use to access the Service. We strongly recommend that you use a unique, strong password that you do not use for any other online service.
Account Termination
You may terminate your account at any time through your account settings. We reserve the right to suspend or terminate your account if we suspect that the information you provided is inaccurate, incomplete, or fraudulent, or if you violate these Terms.
If we terminate your account for violations of these Terms, you are prohibited from creating a new account under your name, a fake or borrowed name, or the name of any third party.
User Content and Conduct
Your Content
Our Service allows you to create, upload, store, and share content, including flight logs, photos, comments, and profile information (“User Content”). You retain all ownership rights in your User Content. By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with operating and providing the Service.
When you delete User Content, we will remove it from active systems within 30 days, though copies may persist in backup systems for a limited time.
Public Content
If you choose to make your profile public or share individual flights, you understand that this content will be visible to anyone who accesses your public profile URL. Public content may be indexed by search engines and appear in search results.
Prohibited Conduct
You agree not to use the Service to:
- Violate any applicable laws, regulations, or third-party rights
- Upload or share content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Impersonate any person or entity, or falsely misrepresent your affiliation with a person or entity
- Upload or transmit viruses, malware, or any other malicious code
- Interfere with or disrupt the Service or connected servers or networks
- Attempt to gain unauthorized access to any portion of the Service or other accounts
- Use any automated means (including bots, scrapers, or crawlers) to access the Service without our express written permission
- Collect or harvest any personally identifiable information from the Service
- Use the Service for any commercial purpose without our prior written consent
- Reverse engineer, decompile, or otherwise attempt to discover the source code of the Service
- Remove, circumvent, or interfere with security-related features of the Service
Content Monitoring
We reserve the right, but have no obligation, to monitor User Content submitted to the Service. We may remove or modify any User Content that violates these Terms or that we find objectionable for any reason, at our sole discretion.
Frequent Flyer Program Information
Jetmap allows you to track your status and progress across various airline frequent flyer programs. You are solely responsible for ensuring the accuracy of the frequent flyer information you enter. We are not affiliated with, endorsed by, or sponsored by any airline or frequent flyer program.
The frequent flyer calculations, status predictions, and earn rate projections provided by Jetmap are estimates based on information you provide and publicly available program rules. Actual status credits, points, and tier progression may differ from our calculations. We strongly recommend verifying all status and points information directly with your airline's official frequent flyer program portal.
Intellectual Property Rights
Our Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are owned by Jetmap and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You are not permitted to use our Trademarks without our prior written consent.
Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial use. This license does not include any right to resell, modify, create derivative works of, or commercially exploit the Service or its contents.
Subscription Services and Payment
Jetmap Premium
Jetmap offers a Premium subscription tier that provides additional features, including:
- Unlimited flight logging (free plan limited to 100 flights)
- Advanced import and export capabilities
- PDF logbook generation
- Enhanced frequent flyer analytics and scenario planning
- Multiple frequent flyer membership tracking
- Individual flight sharing
- Priority customer support
- Ad-free experience
- Additional features as announced
Billing and Payment
Premium subscriptions are billed on a recurring basis (monthly or annually) depending on your selected plan. By subscribing to Premium, you authorize us to charge your chosen payment method at the beginning of each billing period. All fees are exclusive of applicable taxes. Payments are processed securely through Stripe.
Subscription Changes and Cancellation
You may upgrade, downgrade, or cancel your Premium subscription at any time through your account settings. Changes take effect at the start of your next billing period. After cancellation, your account will revert to the free plan at the end of the current billing period. Your flight data will be retained.
Refund Policy
All subscription fees are non-refundable except as required by law. If you believe you were charged in error, please contact us within 30 days of the charge.
Price Changes
We reserve the right to change our subscription prices at any time. If we increase prices, we will provide you with at least 30 days' notice before the new price takes effect.
Third-Party Services and Links
The Service may contain links to third-party websites or resources not owned or controlled by Jetmap. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
We use Google AdSense to display advertisements on our Service. We do not control the content of advertisements and are not responsible for any transactions you enter into with advertisers.
Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.
Data Import and Export
You are solely responsible for ensuring that you have the right to import and use any data you upload to the Service, and that such data does not violate any third-party rights or applicable laws.
You may export your flight data at any time. We encourage you to regularly back up your data by exporting it from the Service.
Disclaimers and Limitations of Liability
Service Provided “As Is”
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JETMAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED AUSTRALIAN DOLLARS (AUD $100), WHICHEVER IS GREATER.
Indemnification
You agree to defend, indemnify, and hold harmless Jetmap and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the Service, your violation of these Terms, or any claim that your User Content caused damage to a third party.
Dispute Resolution and Governing Law
These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia. In the event of any dispute, you agree to first contact us at support@jetmap.au and attempt to resolve the dispute informally.
Any legal action or proceeding arising out of or relating to these Terms shall be instituted exclusively in the courts of Victoria, Australia. Where permitted by law, dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
General Provisions
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jetmap regarding the use of the Service. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations at any time without restriction.
